Kaido is an online platform designed to help teach you how to take care of your health and wellbeing.

Our platform comprises of a web site and mobile apps and is located at https://kaido.org and associated subdomains.

We're deeply committed to providing you with a safe and secure online platform for you to learn how to take care of your health and wellbeing.

This Terms of Use policy sets out the privacy practices for Kaido Group Limited, a company incorporated in England & Wales with company number 09440706 and having its registered office at iCentrum, 6 Holt Street, Birmingham, B7 4BP, United Kingdom ("we", "us", “our").

Terms of Use

Subject to your acceptance of and adherence to these Terms of Use (the "Terms of Use"), Kaido hereby grants you a limited, non-exclusive license to utilise the Kaido Services as set forth herein. The terms "you" and "user" shall refer to all individuals and entities that access the Kaido Services.

By your affirmative actions of registering for and/or using the Kaido Services, you signify your agreement to these Terms of Use and our Privacy Policy and consent to allow Kaido to communicate with you electronically regarding the Kaido Services.

Why should you read these Terms?

These terms create a legally binding agreement between you and us. By accessing or using the Kaido Workplace Wellbeing Solution (“Solution”), you are accepting these Terms, and you confirm and assert to us that you have the right, authority, and capacity to do so.

What to do if you do not want to accept these Terms?

If you do not agree with all of the provisions of these Terms, do not access and/or use the Solution.

Agency

You represent that you are using the Kaido Services for its intended purpose and that you are signing up to Kaido for the purpose of learning more about your health and wellbeing, and not by request of your employer.

The Kaido Services are made available to you on behalf of your employer as part of their employee benefits package and as such content and challenge experiences are unlocked depending on your employer's subscription with us.

By signing up to Kaido you do so at your own risk.

Our Responsibility

On the Kaido Platform

Kaido is a provider of online and mobile content in the health and wellbeing space. Kaido are not a medical device provider, nor should the content our platform and related services provide be considered medical advice - only a registered healthcare professional, such as your doctor, can do that. 

Whilst the Kaido solution provides information to you based on the information you have entered, it is not bespoke to your individual needs and therefore it is your responsibility to ensure that the facilities and functions of the solution meet your requirements. 

Kaido does not diagnose health conditions or make treatment recommendations for you. Kaido is not intended to be relied upon and is not a substitute for professional medical advice based on individual condition and circumstances. You should not take or stop taking any action (such as taking medicines) based on information from the Kaido Wellbeing Solution. You should always talk to a qualified medical professional about any questions you may have.  If you think you have a medical emergency, you should call your doctor or the emergency services immediately. We are not liable for the accuracy, completeness, or suitability for any purpose of the advice, other materials and information published as part of the solution, nor do we make any warranties in relation to the output of the solution.

Any health information or third-party links on the solution, whether provided by Kaido or by a third-party provider are simply for the user's convenience.

On third party websites

The Solution may contain links to third-party websites and services. Where the Site contains links to Third-Party websites, these links are provided for the users' information and convenience only. We have no control over the contents of those sites or resources. Kaido does not review, approve or endorse the content available via Third-Party Links.

The user uses all Third-Party Links at their own risk and should apply a suitable level of caution and discretion in doing so. When the user clicks on any of the Third-Party Links, the applicable third party's terms and policies apply, not these Terms.

How we use Data

Your submission of information, including personal data, through or in connection with the Solution and our use of cookies is governed by the terms of our Privacy Policy as updated from time to time, available at https://kaido.org/privacy

Cancelling your account

You can cancel your Kaido account at any time by emailing support@kaido.co.uk where a member of the team will be happy to delete your account and its associated data at your request.

Warranties and Indemnification

Platform Availability

We will use reasonable efforts to make our Services available 24/7/365, but from time-to-time we will have scheduled outages for maintenance purposes.

Where feasible, we may inform users about planned outages but we are under no obligation to do so, and in any case will not be liable for any service downtime.

Service Warranties

Our services and the data and content within our Platform are provided on an “as is” basis.

To the maximum extent allowed by law, Kaido Group Ltd disclaims all warranties and representations of any kind, including without limitation the implied warranties of fitness for a particular purpose, and non-infringement, whether express, implied, or statutory.You acknowledge and agree that if you rely on any Kaido Wellbeing content or the Kaido Wellbeing solution, you do so solely at your own risk.

Indemnity

You hereby indemnify, defend and hold harmless us, Our affiliates, officers, directors, agents, partners, employees, representatives and third party providers from and against all reasonably foreseeable losses, expenses, damages, costs, claims and demands, including reasonable legal fees and properly incurred associated costs and disbursements, due to or arising out of Your breach of any representation or warranty under these Terms.

Limitation of Liability

Neither Kaido, its suppliers or licensors, nor any other party involved in creating, producing or delivering the Kaido Workplace Wellbeing Solution will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with these terms or from the user or inability to use the Kaido Wellbeing service, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory and whether or not Kaido has been informed of the possibility of such damages, even of a limited remedy set forth herein is found to have failed of its essential purpose. 

Modifications to the Terms of Use

We may make changes to the Terms of Use from time to time. A link to the most current Terms of Use will be available on the Kaido home page and we will indicate the date of the "Latest Update" at the top of the Terms of Use. We may also place a special notice on the Kaido Services or communicate significant changes by email. Your continued use of the Kaido Services following the posting of such changes constitutes your acceptance of the Amended Terms of Use.

Other

The clause headings (and numbers) in these Terms are for ease of reference only and shall not be taken into account in the construction or interpretation of the clauses to which they refer.

This contract shall be governed by the Laws of England and the parties agree to submit to the exclusive jurisdiction of the English Courts.
